These terms are an agreement between you and FILL: legal entity name and registered address (“we”, “us”) covering the The Rising Drop app and this website. By creating an account or using the app, you accept them. If you do not, do not use the app.
The app
The Rising Drop is a personal record-keeping app: you mark your days, keep habits, and run challenges. It is a tool for keeping your own record and nothing more.
It is not medical, psychological, or professional advice. It does not diagnose or treat anything, and it is not a substitute for care from a qualified professional. If you are struggling, please talk to someone qualified to help.
Your account
- You must be at least FILL: age to use the app.
- You sign in with Apple and set a PIN. Keep both to yourself — anything done through your account is treated as done by you.
- One account per person. Do not share it, sell it, or let someone else use it.
- Tell us promptly if you think someone else has access to your account.
Subscriptions and payment
Some features require a paid subscription. Purchases are made through the Apple App Store and are governed by Apple’s terms as well as these.
- Plans and price — FILL: list each plan, its price, and its length, exactly as it appears on the paywall. Prices are shown in the App Store before you buy.
- Free trial — FILL: length and terms, or delete this line if there is none. Any unused portion of a free trial is forfeited when you buy a subscription.
- Auto-renewal — subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before it ends. Your Apple account is charged for renewal within 24 hours of the period ending.
- Managing and cancelling — you can manage or cancel your subscription in your device’s Settings → your name → Subscriptions. Cancelling stops the next renewal; it does not end the period you have already paid for. We cannot cancel it for you.
- Refunds — purchases are handled by Apple, so refunds are Apple’s to give. Request one at reportaproblem.apple.com. Where consumer law in your country gives you a right to a refund, that right stands regardless of this paragraph.
- Price changes — if a price rises, Apple will tell you and ask you to agree before the next renewal.
What you may not do
- Break the law with it, or use it to harm anyone.
- Reverse-engineer, decompile, or try to extract the source, except where the law says you may.
- Probe, scrape, overload, or interfere with the service, or work around its limits, authentication, or paywall.
- Resell, sublicense, or offer the service to others as your own.
- Upload anything unlawful into your record, or anything you do not have the right to hold.
Your content
What you write stays yours. You give us only the permission we need to store it, back it up, and show it back to you on your devices. We do not claim ownership and we do not use it to train anything. See the Privacy Policy for how it is handled.
Our content
The app, the website, the name The Rising Drop, and everything in them belong to us or our licensors. You get a personal, limited, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, for as long as these terms are kept.
Availability
We try to keep the service running, but we do not promise it will always be available or error-free. We may change, suspend, or discontinue features. If we ever shut the service down, we will give you reasonable notice and a way to export your record.
Ending it
You can stop at any time by deleting your account in the app. We may suspend or close an account that breaks these terms, or where we are required to by law — with notice where we reasonably can. Closing an account does not refund a subscription period already paid for, unless the law requires it.
Disclaimers
To the fullest extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these exclusions, in which case they do not apply to you.
Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the FILL: e.g. 12 months before the claim, or FILL: e.g. USD 50. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
Apple
Apple is not a party to these terms and has no obligation to support or maintain the app. Apple is not responsible for any claim about the app, including product liability, failure to conform to a legal requirement, or consumer-protection claims — those are ours. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms. The date at the top will change, and for material changes we will tell you in the app before they take effect. Continuing to use the app after that means you accept the new terms.
Governing law
These terms are governed by the laws of FILL: jurisdiction, and disputes will be heard in the courts of FILL: courts. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
